RESIDENCE PERMIT

After entering Romania you must obtain a residence permit. It certifies your right to stay in Romania and you can get it from the territorial units of the General Inspectorate for Immigration in the county where you live. To obtain a residence permit you have to submit personally a number of documents at least 30 days before the expiry of the right to stay granted by the visa. You also have the possibility to submit the documents through the online service, available at https://portaligi.mai.gov.ro/portaligi/

In order to obtain a residence permit as a family member of a Romanian citizen, your family members must submit the following documents:

The husband / wife of the Romanian citizen

a. application

b. original crossing border document (passport, travel document, etc.) and copy;

c. the identity document of the Romanian citizen;

d. marriage certificate issued by the Romanian authorities (in case the marriage was made abroad, the certificate will be transcribed at the Romanian Civil Status Offices);

e. a written declaration stating that the foreigner has not entered into another marriage;

f. proof of legal possession of the living space at the address where he/she declares that he/she resides on the territory of Romania in original and copy;

g. proof of social health insurance;

h. medical certificate;

i. fees.

Foreigners who live with the Romanian citizen, the residence permit is granted only if they have not another marriage and have a child together)

a. application;

b. the original crossing border document (passport, travel document, etc.) and copy;

c. the identity document of the Romanian citizen;

d. the birth certificate of the child, Romanian citizen, resulting from the cohabitation between the applicant and the Romanian citizen;

e. the declaration of the Romanian citizen from which it should result that they live together;

f. proof of legal possession of the living space at the address where he/she declares that he/she resides on the territory of Romania, in original and copy;

g. documents showing that both the foreigner and the Romanian citizen are unmarried;

h. proof of social health insurance;

i. medical certificate;

j. fees.

Family members of the Romanian citizen and those who prove that they are registered with the right of residence in another Member State in this capacity (children of the Romanian citizen, of the spouse or partner, including adopted children who have not reached the age of 21 or who is dependent on the Romanian citizen, his / her spouse or partner)

a. application;

b. the original crossing border document (passport, travel document, etc.) and copy;

c. the identity document of the Romanian citizen;

d. birth certificate or other documents proving the kinship issued by the competent authorities, translated and superlegalized or apostille – copy and original,

e. the declaration of the Romanian citizen from which it results that they live together;

f. proof of legal possession of the living space at the address where he/she declares that he/she resides on the Romanian territory in original and copy;

g. proof of social health insurance;

h. medical certificate;

i. fees.

First degree relatives in ascending line of the Romanian citizen or of the spouse

a. application;

b. the original crossing border document (passport, travel document, etc.) and copy;

c. the identity document of the Romanian citizen;

d. documents attesting the kinship issued by the competent authorities, translated and superlegalized or apostille – copy and original

e. in the situation where the foreigner is the parent of a minor Romanian citizen, he/she must prove that the minor is in his/her care or that there is an obligation to pay the alimony, an obligation that the foreigner fulfills regularly;

f. proof of legal ownership of the living space;

g. proof of social health insurance;

h. medical certificate;

i. fees.

To obtain a residence permit as a family member of a non-EU citizen, your family members must submit the following documents:

We mentioned that the sponsor is considered the foreign citizen with the right to stay in Romania.

The sponsor’s spouse

a. application

b. border crossing document – original and copy;

c. marriage certificate, issued by the competent authorities, translated and super legalized / apostille – copy and original;

d. the sponsor’s written statement or other documents showing that there is no state of bigamy or polygamy

e. the written statement of the sponsor stating that they will actually live together;

f. proof of legal ownership of the living space – original and copy;

g.proof of means of support;

h. proof of social health insurance;

i. medical certificate;

j. fees.

Sponsor family members

a. application;

b. border crossing document – original and copy;

c. the birth certificate or other documents proving the kinship relationship issued by the competent authorities, translated and super legalized / apostille – copy and original;

d. the written statement of the sponsor stating that they will actually live together.

e. the written declaration of the person who holds together with the sponsor the joint custody of the minor child for whom the family reunification is requested, from which should result the consent that he / she should live together with the sponsor on the territory of Romania;

f. copy of the document certifying the right of residence on the Romanian territory;

g. statement in authentic form / document issued by a medical institution;

h. proof of legal ownership of the living space – original and copy;

i. proof of means of support;

j. proof of social health insurance;

k. medical certificate;

l. fees.

If you are applying for family reunification and you have refugee or subsidiary protection status, you do not have to present documents proving ownership of the living space, means of subsistence or proof of social health insurance.

Right of residence independently:

 is granted to family members of the non-EU / EEA citizen who held a temporary residence permit, but the conditions for which it was granted are no longer met: they become of age or have reached the age of 21, if they are family member of the Romanian citizen, the sponsor / Romanian citizen has died, the dissolution of the marriage has been pronounced or the partnership has ended:

upon request to foreigners who are holders of a temporary residence permit granted for the purpose of family reunification or have had the right of temporary residence for the purpose of family reunification in the last 5 years prior to the application. In the case of family members of EU Blue Card holders, the 5-year period can be calculated by combining their periods of residence in different Member States.

Required documents:

a. application;

b. the original crossing border document (passport, travel document, etc.) and copy;

c. the temporary residence permit previously issued;

d. documents showing that there is one of the following situations: they become adults, or have reached the age of 21 if they are a family member of a Romanian citizen,

the sponsor / Romanian citizen has died, the dissolution of the marriage has been pronounced or the partnership has ended (the applicant will additionally present, as the case may be, the birth certificate, the death certificate or the court decision to dissolve the marriage);

e. proof of legal ownership of the living space;

f. proof of means of support;

g. proof of social health insurance;

h. medical certificate;

i. fees.

The residence permit as a family member of a Romanian citizen must be renewed at least 30 days before the expiry of the previous one.

Application for the granting or renewal of a residence permit for family members of citizens of non EU / EEA will be settled within 30 days from the date of its submission. The term for the obtaining of a temporary residence permit as a family member of a Romanian citizen the resolution term is of as much as 90 days, and for the subsequent permits it is 30 days. In case that further checks are required, the deadline for resolving the application may be extended by 15 days.

The right of temporary stay is extended individually for each family member, by the same period for which the sponsor was granted the right to stay.

Husband / wife and family members of a Romanian citizen or of a sponsor holder of a long stay right may be granted extension of their temporary right of residence for periods of up to 5 years.

The family member of the Romanian citizen residing abroad can be granted the extension of the temporary residence right for a period not exceeding the period of validity of the provisional identity card of the Romanian citizen.

The independent residence permit will have a 6 months validity, during which the applicant will be able to focus on another goal of their stay in Romania.

If the information or documents provided on which the application for the extension of the right of residence is based are inadequate or incomplete, the General Inspectorate for Immigration shall inform the applicant of the additional information requested and shall set a reasonable time limit for sending them, but not more than 30 of days. The term stipulated in paragraph (4) shall be suspended until the General Inspectorate for Immigration has received the necessary additional information or documents. If no additional information or documents have been provided by the deadline, the application may be rejected.

An extension of the right of residence shall not be granted where it is established:

a) the existence of a state of bigamie or polygamy;

b) that the two spouses no longer have a marital relationship or an effective family relationship on the territory of Romania;

c) that the alien recognized the siblings of a Romanian child exclusively for the purpose of obtaining the right of residence.
