Information on the processing of personal data at the level of the General Inspectorate for Immigration

Who are we?

The General Inspectorate for Immigration (I.G.I.) as a personal data controller, is organized and operates as a specialized structure of the central public administration, a public institution with legal personality, subordinated to the Ministry of Internal Affairs. The General Inspectorate for Immigration, as a personal data controller, processes personal data that may subsequently be the subject of an automatic or non-automatic recording system, or that are intended to be included in such a system, in a distinct manner, for purposes specific to the field of activity and for its own administrative purposes, consciously and responsibly assuming the application of the principles and norms regarding the protection of individuals with regard to the processing of personal data. The personal data controller is the General Inspectorate for Immigration, with headquarters in Bucharest, str. Lt.col.Marinescu Constantin, no. 15 A, sector 5.

Our institution carries out processing activities, based on the specific attributions assigned to it by the normative acts in force, in accordance with the provisions of Regulation (EU) No. 679 of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation).

The legal basis underlying the specific personal data processing activities is regulated by the following normative acts:

Law no. 122/2006 on asylum in Romania;

GEO no. 194 of 12 December 2002 on the regime of foreigners in Romania;

GEO no. 102 of 14 July 2005 on the free movement on the territory of Romania of citizens of the Member States of the European Union, the European Economic Area and citizens of the Swiss Confederation;

OG no. 44 of 29 January 2004 on the social integration of foreigners who have acquired international protection or a right of residence in Romania, as well as citizens of the Member States of the European Union and the European Economic Area;

OG no. 25 of 26 August 2014 on the employment and posting of foreigners on the territory of Romania and for the amendment and completion of certain normative acts regarding the regime of foreigners in Romania;

GD no. 639 of 20 June 2007 on the organizational structure and powers of the General Inspectorate for Immigration;

LAW no. 190 of 18 July 2018 on implementing measures for Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation);

The General Inspectorate for Immigration processes your personal data for the application of the legal provisions regarding the regulation of the aliens and asylum regime in Romania, the production/personalization of documents issued to aliens/EU/EEA citizens, as well as their family members and those from third countries, the application of the legal provisions regarding the free movement of citizens of EU/EEA member states on the territory of Romania and their right to elect and be elected under the law during elections in Romania, processing of data of Schengen interest, the application of the legal provisions regarding the issuance of the local border traffic permit/the application of the legal provisions regarding the public pension system and other social security rights/the application of the legal provisions in the process of processing and storing biometric data for the purpose of issuing travel documents and residence permits, which contain biometric elements for the identification of the holder.

To whom do we transmit your personal data?

The information provided by you is intended for use by the General Inspectorate for Immigration and may be communicated, as appropriate, under the terms of the law, to central or local public authorities, diplomatic representations of Romania, judicial authorities, local health services and other institutions with which the General Inspectorate for Immigration collaborates, in order to exercise the powers conferred on them by law.

For what period do we process your data?

Personal data will be stored for the period necessary to fulfill the purposes and obligations established by law, and will subsequently be deleted – under the conditions of the specific applicable legislation.

What rights do you have?

In accordance with the provisions of the General Data Protection Regulation, data subjects have the following rights:

  • The right to information, provided for in art. 13 and art. 14 – the right of the data subject to be informed of the identity and contact details of the controller and the data protection officer, the purposes for which the data are processed, the categories of personal data concerned, the recipients or categories of recipients of the data, the existence of the rights provided for by the legislation on the protection of personal data for the data subject and the conditions under which they may be exercised;
  • The right of access to data, provided for in art. 15 – the right of the data subject to obtain from the data controller, upon request and free of charge, confirmation of whether or not personal data concerning him or her are being processed by him or her;
  • The right to rectify inaccurate data concerning him/her, as well as to complete incomplete data, provided for in art. 16 – the exercise of this right can be achieved by means of a reasoned request, addressed to the General Inspectorate for Immigration, with headquarters at Str. Lt.col. Marinescu Constantin, no. 15 A, sector 5, Bucharest;
  • The right to erasure of data (“right to be forgotten”), provided for in art. 17 – the right of the data subject to obtain, upon request and free of charge, to the extent that the conditions provided for by law are met, the erasure of personal data concerning that person;
  • The right to restriction of processing, provided for in art. 18 – the right of the data subject to obtain, upon request and free of charge, to the extent that the conditions provided for by law are met, the marking of stored personal data, with the aim of limiting their further processing;
  • The right to data portability, provided for in art. 20 – the right of the data subject to receive, upon request and free of charge, personal data in a structured, commonly used and easily readable format, as well as the right to have these data transmitted by the controller to another data controller, to the extent that the conditions provided for by law are met;
  • The right to object, provided for in art. 21 – the right of the data subject to object at any time, for justified and legitimate reasons relating to his or her particular situation, to the processing of personal data concerning him or her, to the extent that the conditions provided for by law are met;
  • The right not to be subject to an individual decision, provided for in art. 22 – the right of the data subject to request and obtain the withdrawal, annulment or re-evaluation of any decision based exclusively on processing carried out by automated means (including profiling) which produces legal effects concerning the data subject or similarly significantly affects him/her.

Where the processing is based on Article 6(1)(a) “the data subject has given consent to the processing of his or her personal data for one or more specific purposes” or Article 9(2)(a) “the data subject has given explicit consent to the processing of those personal data for one or more specific purposes, unless Union or national law provides that the prohibition referred to in paragraph 1 may not be lifted by the data subject’s consent” of the GDPR, you have the right to withdraw your consent at any time, without affecting the lawfulness of the processing carried out on the basis of consent before its withdrawal. You may therefore amend or withdraw your consent at any time, and we will act immediately accordingly, unless there is a legal reason or legitimate interest not to do so.

To exercise these rights, you can address a written, dated and signed request to the headquarters of the General Inspectorate for Immigration, str.Lt.col. Marinescu Constantin, no. 15 A, sector 5, Bucharest, or by e-mail: saeri.igi@mai.gov.ro, and within one month you will receive a response to the request expressed pursuant to Regulation no. 679/2016.

Exercise of the rights of the data subjects through the National Supervisory Authority for the Processing of Personal Data:

According to the provisions of art. 77, art.78 and art.79 of Regulation no. 679/2016, you can file a complaint with the National Supervisory Authority for Personal Data Processing (www.dataprotection.ro), respectively to the judiciary for the defense of any rights guaranteed by the applicable legislation in the field of personal data protection, if you consider that your rights provided for by Regulation no. 679/2016 have been violated.

In the situations provided for in art.15, art.17 paragraph (3) or art. 19 paragraph (6) of Law no. 363/2018, the data subject has the possibility to exercise his/her rights also through the National Supervisory Authority for Personal Data Processing.
